Terms of Service

1. Acceptance of Terms
These Terms of Service are an agreement between you and Haputa LLC ("FrontHouse", "we", "us"). "You" means the food business, and the person authorized to bind it, that creates a FrontHouse account. By creating an account, clicking to accept, or using FrontHouse, you agree to these terms. If you do not agree, do not use the service.
You may use FrontHouse only for your own business. These terms do not create a contract between FrontHouse and your end customers. Your relationship with the people who order from you is yours.
2. Description of Service
FrontHouse is software for vendors who sell food at a truck, stall, pop-up, or similar location. It lets your customers place orders by text message and at a walk-up kiosk, shows those orders on a kitchen display, sends loyalty messages, and gives you a dashboard to run the business. We provide the software. You provide the food, the staff, and the place of sale.
3. Accounts
3.1 Eligibility
FrontHouse is for business use. The person who opens the account must be at least 18 years old and authorized to bind the business. You must give us a real business name and a working email address.
3.2 Owner and staff users
The owner controls the account, including billing, the menu, and who else can sign in. The owner may invite staff users. Staff can use the features the owner allows. The owner is responsible for what staff do with the account, including orders they accept, refunds they issue, and messages they cause the service to send.
3.3 Account security
You are responsible for keeping passwords and signed-in devices safe. Tell us promptly at support@fronthouseos.com if you think someone else is using your account. We may suspend an account that we believe is compromised, until you can secure it.
4. Subscription and Billing
4.1 The plan
FrontHouse is a single plan at $149 per month, billed in advance. LemonSqueezy is the Merchant of Record for the subscription. LemonSqueezy charges you, issues the receipt, and handles sales tax on the subscription. FrontHouse does not store your card number.
4.2 Automatic renewal
The subscription renews each month until you cancel. By starting a subscription you authorize LemonSqueezy to charge the payment method on file for each renewal.
4.3 Failed payments
If a renewal charge fails, we will tell you and LemonSqueezy may retry it. If the invoice stays unpaid, we may suspend the account. Suspension stops new orders and outbound messages. We restore access after the invoice is paid, unless the account has been terminated.
4.4 Cancellation
You may cancel at any time from the billing page. There is no term contract. After you cancel, you keep access until the end of the period you have already paid for. We do not refund partial months.
4.5 Price changes
We may change the monthly price. We will email the owner at least 30 days before a higher price applies to your account. If you do not agree, cancel before the new price takes effect. Continuing after that date means you accept the new price.
4.6 SMS allowance and top-up packs
The plan includes up to 2,500 SMS messages per month. Each text sent to a customer counts as one message. Opt-out, help, and other required replies do not count. The allowance resets on the first day of each calendar month, and unused messages do not carry over.
If you need more, you can buy SMS top-up packs from the billing page. Top-up packs are one-time purchases sold by LemonSqueezy, our Merchant of Record. Top-up messages are used only after the monthly allowance runs out. They do not expire while your subscription is active, and they end when your account is closed. A refund of a top-up pack removes its unused messages.
If you run out of messages, FrontHouse stops sending texts to customers until you buy a top-up pack or the next month begins. Ordering, the kitchen display, and loyalty tracking keep working. We email the owner when the account reaches 80% and 100% of the monthly allowance.
5. Payments to Vendors
When a customer pays for food, the payment is processed by Stripe on your own Stripe account, under Stripe's terms. You are the merchant of record for those food sales. FrontHouse takes no commission on food sales and never holds those funds. Stripe pays out to the bank account you connect, minus Stripe's own processing fees, which you pay to Stripe.
Chargebacks, refunds, and payment disputes on food sales are your responsibility. If you refund an order, you do it from your Stripe account. FrontHouse can record the refund in the dashboard, but we do not advance you the money.
6. Vendor Responsibilities
You are responsible for the business you run on FrontHouse. That includes keeping your menu and prices accurate, preparing food safely, and holding the permits and licenses your city and state require. You collect and remit any sales tax that applies to your food sales. You also follow consumer-protection and messaging laws that apply to your customers, including getting any consent the law requires before you ask FrontHouse to text them.
7. SMS Program
7.1 Program description
FrontHouse sends text messages on your behalf. Those messages are order confirmations, order-ready notices, payment links, and loyalty rewards tied to a customer's orders. They are transactional messages about an order or a reward the customer has earned, not a general marketing list you upload.
7.2 Who the message is from
Messages are sent from a FrontHouse phone number and labeled with your business name, so the customer can tell which vendor the order belongs to.
7.3 Frequency
Message frequency varies with orders. A customer who orders more often receives more messages. There is no fixed number of texts per week.
7.4 Rates
Message and data rates may apply. FrontHouse does not charge the customer's phone bill. Their carrier does.
7.5 Help
A customer can reply HELP for help, or email support@fronthouseos.com.
7.6 Opting out
A customer can reply STOP to opt out. Because messages come from a shared FrontHouse number, STOP opts the customer out of messages from all FrontHouse vendors, not only yours. They can reply START to resume.
7.7 Carriers
Mobile carriers are not liable for delayed or undelivered messages. Delivery depends on the carrier and the handset, and we do not guarantee that a text arrives.
8. Customer Data
You control the customer data in your account, including phone numbers, order history, and loyalty status. FrontHouse processes that data on your behalf, and only to provide the service. We do not sell it. How we handle personal information is described in our Privacy Policy.
9. Acceptable Use
You will not use FrontHouse for anything unlawful. You will not send spam, and you will not use the service to send marketing texts to people who have not agreed to receive them. You will not reverse engineer the service, probe it for vulnerabilities, or interfere with other vendors' accounts or with the network that runs FrontHouse. We may suspend an account that breaks this section.
10. Intellectual Property
FrontHouse, the software, and our logos belong to Haputa LLC. These terms give you a limited right to use the service while your subscription is active. They do not sell you the software or the brand. You keep ownership of your menu, your business name, and your customer list. You give us permission to host and display that material so we can operate the service for you.
11. Service Availability
The service is provided as it is available. We will try to keep it running, and we will sometimes take it down for maintenance. We do not promise a particular uptime, and a busy lunch service is not a guarantee that the service will be up at that moment. Features described on the website may ship over time.
12. Disclaimers
The service is provided "as is" and "as available". To the extent the law allows, we disclaim warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that orders will be free of errors, that texts will arrive, or that the service will meet your sales goals. Some states do not allow these disclaimers, and in those states they apply only as far as the law permits.
13. Limitation of Liability
To the extent the law allows, Haputa LLC and its members and staff are not liable for indirect, incidental, special, consequential, or lost-profit damages, or for the cost of substitute services, even if we were told those damages were possible. Our total liability for any claim arising out of the service is capped at the fees you paid us for FrontHouse in the 12 months before the claim. This cap does not apply where the law does not allow it, including liability for fraud or for injury caused by gross negligence.
14. Indemnification
You will defend and indemnify Haputa LLC against claims brought by a third party, including one of your customers, that arise from your food, your menu, your prices, your failure to collect a tax you owe, or your instructions to message someone who did not consent. We will tell you about the claim and let you control the defense, as long as you do not settle it in a way that admits fault on our part without our agreement.
15. Termination
15.1 By you
You may stop using FrontHouse and cancel the subscription at any time, as described in section 4.4.
15.2 By us
We may suspend or close an account that does not pay, that breaks these terms, or that we reasonably believe is being used to harm other people or the service. Where we can do it without creating a risk, we will email you first and give you a chance to fix the problem.
15.3 Data after termination
After the account closes, we keep information only as the Privacy Policy describes, and then we delete it or anonymize it. Export anything you need before you cancel. We do not promise to hold a copy for you after the retention period.
16. Changes to These Terms
We may update these terms. If we make a change that affects your rights or your bill, we will email the owner at least 30 days before it applies. The "Last updated" date at the top will change. If you keep using FrontHouse after the new terms apply, you accept them. If you do not accept them, cancel before that date.
17. Governing Law
These terms are governed by the laws of the State of California, without regard to conflict-of-law rules. The state and federal courts located in Santa Clara County, California, are the exclusive venue for disputes arising out of these terms or the service, and you consent to personal jurisdiction there.
18. Severability and Entire Agreement
If a court holds one part of these terms unenforceable, the rest stays in effect. These terms, together with the Privacy Policy and any order you place through LemonSqueezy for the subscription, are the entire agreement between you and Haputa LLC about FrontHouse. They replace earlier conversations about the same subject. A failure to enforce a term once is not a waiver of it later.
19. Contact
Haputa LLC operates FrontHouse. Questions about these terms can be sent to support@fronthouseos.com, or through the support page.
